Hope Fertility App — for Patients

1. SCOPE

These Terms of Use apply to the use of the Hope Fertility App (hereinafter "App") by patients of fertility clinics that use the Hope system. The provider of the App is Hope Applications GmbH, Eggerstedtstr. 51, 22765 Hamburg, Germany (hereinafter "Hope").

2. DESCRIPTION OF SERVICES

The Hope App enables you as a patient to communicate digitally with your fertility clinic. Through the app you can in particular:

  • View your treatment plan, medications and appointments
  • Receive treatment results and medical findings
  • Receive documents and medical letters digitally
  • Communicate securely with your clinic (chat with automatic translation)
  • Complete and submit medical history forms digitally
  • Sign consent documents and contracts digitally (eSignature)
  • Access evidence-based information relevant to your treatment phase

The App is free of charge for patients and available for iOS (Apple App Store) and Android (Google Play Store).

3. REGISTRATION AND ACCESS

Access to the App requires that your clinic uses the Hope system and provides you with a QR code. By scanning the QR code, an encrypted connection is established between your device and the clinic's system (MedITEX). No separate user account with Hope is required. You are obligated to protect your device from unauthorized access and not to share the QR code with third parties.

4. TECHNICAL REQUIREMENTS

To use the App you will need:

  • A compatible smartphone running a current version of iOS or Android
  • An active fertility treatment at a clinic participating in the Hope system
  • A working internet connection for data transmission

5. MEDICAL DISCLAIMER

The content provided in the App — including treatment plans, informational materials, and the Fertility Guide — is intended solely to support and inform you in the context of your ongoing treatment. It does not replace medical consultation, advice, or diagnosis under any circumstances. For all medical decisions, please consult your treating medical team.

6. AVAILABILITY

Hope strives for high availability of the App and its underlying infrastructure. However, there is no entitlement to uninterrupted availability. Maintenance work, technical disruptions, or circumstances beyond Hope's control may temporarily limit availability.

7. USER OBLIGATIONS

You agree:

  • To use the App solely for its intended purpose
  • Not to transmit any content that is unlawful, offensive, or misleading
  • To protect your device and access to the App from unauthorized use
  • To notify Hope immediately if you become aware of any misuse: hi@hope-app.net

8. INTELLECTUAL PROPERTY

All content in the App — including texts, graphics, design, trademarks, andsoftware — is protected by copyright and is the property of Hope Applications GmbH or licensed third parties. Reproduction, distribution, or any other use outside the App is not permitted without explicit written consent.

9. LIABILITY

Hope is not liable for:

  • Errors or delays in data transmission caused by your clinic, your device, or third parties
  • Damages resulting from improper use of the App
  • The medical accuracy of content transmitted by your clinic through the App — this is the responsibility of the treating clinic

Hope's liability for slight negligence is excluded to the extent permitted by law. Liability for damages resulting from injury to life, body or health, and for intentional or grossly negligent conduct, remains unaffected.

10. AMENDMENTS TO THESE TERMS

Hope reserves the right to amend these Terms of Use as needed. You will be notified of material changes within the App. Continued use of the App after notification of changes constitutes acceptance.

11. TERMINATION

You may end your use of the App at any time by uninstalling it. No separate notice of termination is required. Upon completion of your treatment or at the request of your clinic, access to the App may be deactivated.

12. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Federal Republic of Germany. For consumers, the mandatory protective provisions of the country in which you are habitually resident apply in addition. The place of jurisdiction for disputes with businesses is Hamburg, Germany.
